At Heiligen (Worldwide Services) Pvt.Ltd, we strongly believe that multi-faceted approach is needed to fight spam effectively. Prevention, consumer awareness, filtering techniques and use of national laws with due diligence

Objective:
To promote the adoption of appropriate and harmonized anti-spam legislation in countries.
To encourage cooperation internationally, in order to tackle the problem of spam comprehensively and to ensure effective enforcement of applicable rules.
Please read the Heiligen Spam Agreement and electronically sign it below. The completion of this agreement is required to become eligible for use of any part of our services or access product/Service informations.

Heiligen (Worldwide Services) Pvt.Ltd, here in after known for all legal purposes as “Heiligen” has created this Spam Agreement to demonstrate our firm commitment to keeping with the industry standards of Internet marketing. Further, we agree to abide by the rules of CAN SPAM Act regulating the delivery of e-mail communications and such laws applicable as per the cyber laws of India and International “No Cyber deformation laws”.

This agreement shall conduct the terms and conditions by which you will be permitted to deliver e-mail (e-mail security Policy) solicitations promoting Heiligen or any of their Group companies.

Heiligen recognizes an e-mail as "spam" if:

• The recipient is unable to easily unsubscribe from the e-mail list;
  
  
• The transmission contains invalid or forged headers, invalid or non-existent domain  names, or other means of deceptive addressing, or;
  in the opinion of the recipient, the transmission and reception of the message appears to give a disproportionate benefit to the sender.

By signing in the space below, you agree, in consideration for our willingness to continue allowing your distribution of e-mails promoting Heiligen services, that at all times during which you distribute any e-mails for the purpose of Heiligen Exclusive services that you will comply with all applicable laws relating thereto and adhere to the following obligations:

1. E-mails promoting Heiligen shall not contain or include a falsified sender domain name or non-responsive IP address;
   
   
2. E-mails promoting Heiligen shall not contain or include a false or misleading subject line that attempts to disguise or conceal the content of the e-mail nor violate any provision of INDIAN Laws & all applicable international Laws.
   
   
3. All e-mails shall contain or include valid and responsive contact information of the sender, list manager; this includes your physical address and (optionally) your phone number.
   
   
4. You shall be permitted to use brokers or third parties to deliver e-mails only if each acts in compliance with the terms of this Agreement, agrees to fully and completely indemnify you and Heiligen for all damages arising from their breach of any of the obligations set forth herein and you have the ability to terminate distribution with or procurement by any such third party on not more than 24 hours notice. You shall be solely responsible for any breach of these obligations by any such third party;
   
   
5. Every e-mail sent by your or by any other party on your behalf shall include a valid physical postal address of the entity principally responsible for sending the e-mail communication and such other parties as Heiligen may notify you it reasonably deems are necessary in order to remain in compliance with applicable laws,
   
   
6. You shall distribute such e-mails only to those recipients who have expressly agreed directly with you, in advance, to receive such transmissions from you (i.e., "opted-in")
   
   
7. Unless otherwise directed by Heiligen in writing, you shall not use Heiligen or it's represented group names (including any abbreviation thereof) or any trademark, trade name, service mark, logo or other Heiligen identifying information in the originating or return e-mail address line, header or subject line of any e-mail transmission and that all e-mail transmissions shall contain language in the body and both the "from" line as well as the "subject" line that clearly announces that purposes of the e –mail.
   
   
8. Upon request by Heiligen, you shall promptly provide us with (i) a point of contact at your office for handling customer complaints received by Heiligen and
   (ii) information regarding consumer responses to the e-mail distribution and any and all records verifying that recipients consented to receive the e-mail transmissions in question
   
   
9. In the event of any breach of this letter agreement by you or and third party or licensee, Heiligen shall, in addition to all other remedies available to it, have the right to refuse to make any payments to you as a result of your efforts that cannot be verified by you as having complied with the terms and conditions hereof, and
   
   
10. You shall indemnify, defend and hold Heiligen harmless from any cost, expense or liability arising out of any breach or alleged breach of your obligations under this letter.

To participate in anti-spam movement and prevent from e-mail fraud, phishing & spoofing Heiligen has adopted the following as procedures for all of its e-mail distribution communications:

Valid addressing
The e-mail communication shall be sent to a single recipient with the intention of it being received by only one individual. The sender address will be a valid Heiligen private Limited e-mail address that is monitored by a Heiligen employee.

Valid headers/subjects
The e-mail communication will always have a header or subject that is appropriate and true to the content provided in the communication. The header or subject will not be used inappropriately or give a disproportionate benefit to the sender.

Valid contact information
Any contact information in the e-mail communication will be real and relevant .

Valid subscribe/unsubscribe service
The e-mail communication will always have the Heiligen subscription informations, if any, at the end. Heiligen website will always provide information on how to subscribe or unsubscribe to any of its e-mail distribution.
Heiligen also has a strict privacy policy posted on all their websites, which addresses the fact that information collected by Heiligen is not sold, but used for marketing and telemarketing campaigns.

Relevant and beneficial information for the recipient
Heiligen attempts to provide honest information about our company/ Partner products, services, or other information, which we feel will be in some way relevant and beneficial to the recipient.

Mindfulness and compliance with company policies
Heiligen‘s  e-mail distributions will be mindful and in compliance with its current Privacy Policy.
In addition, e-mail sent, or caused to be sent, to or through the Services may not:

• use or contain invalid or forged headers;
• use or contain invalid or non-existent domain names;
• employ any technique to otherwise misrepresent, hide or obscure any information in identifying the point of origin or the transmission path;
• use other means of deceptive addressing;
• use a third party's internet domain name, or be relayed from or through a third party's equipment, without permission of the third party;
• contain false or misleading information in the subject line or otherwise contain false or misleading content;
• fail to comply with additional technical standards described below; or
• Otherwise violate the applicable Terms of Use for the Services.

Heiligen does not permit or authorize any attempt to use the Services in a manner that could damage, disable, overburden or impair any aspect of any of the Services, or that could interfere with any other party's use and enjoyment of any Service.

If Heiligen believes that unauthorized or improper use is being made of any Service, it may, without notice, take such action as it, in its sole discretion, deems appropriate, including blocking messages from a particular internet domain, mail server or IP address. Heiligen may immediately terminate any account on any Service which it determines, in its sole discretion, is transmitting or is otherwise connected with any e-mail that violates this policy.
Nothing in this policy is intended to grant any right to transmit or send e-mail to, or through, the Services. Failure to enforce this policy in every instance does not amount to a waiver of Heiligen’s rights.
Unauthorized use of the Services in connection with the transmission of unsolicited e-mail, including the transmission of e-mail in violation of this policy, may result in civil, criminal, or administrative penalties against the sender and those assisting the sender.

You acknowledge that you are independent personnel / entity, and that nothing in this agreement or our business together shall create any form of partnership, agency relationship or joint venture. We acknowledge that you retain control over all aspects of your business and except as specifically set forth herein, the manner in which you transmit e-mail solicitation. Thus, except as set forth herein, you retain control over the time, number, frequency and recipients of your e-solicitations and control over the personnel, equipment and methods used for the transmissions. Heiligen is not requiring you to send any e-mails under this letter agreement; provided however, in order to receive payment for any e-mail solicitations that you send, you must comply with the specific requirements set forth herein.
Please confirm your acceptance and understanding of the terms and conditions set forth in this letter by electronically signing in the space provided below. This agreement shall supplement any previously executed agreement between us, including any provisions relating to "Spam" in Heiligen standard contract, and in the event of any conflict between the provisions of this agreement and any other agreement, the terms of this Agreement shall control. We are hopeful that the obligations set forth herein will assure that our on-line marketing efforts continue to uphold high levels of integrity with Internet consumers and the Internet community at large. We appreciate your cooperation in addressing this matter.
